Please read these Terms of Service ("Terms") carefully before using the xpos.dev SSH tunneling service (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Quick Summary: xpos.dev is a free SSH tunneling service. You're responsible for what you tunnel. We provide the service "as is" without warranties. We can terminate service at any time. Don't use it for illegal activities or abuse. 3-hour session limit. Read the full terms below for details.
1. Acceptance of Terms
By using xpos.dev, you agree to:

- All applicable laws and regulations
These Terms constitute a legally binding agreement between you and xpos.dev ("we," "us," or "our").
2. Eligibility
You must meet the following requirements to use the Service:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using the Service under applicable laws
- Comply with all local laws regarding online conduct and acceptable content
3. Description of Service
xpos.dev provides SSH-based tunneling services that allow you to:
- Create temporary public URLs for local development servers
- Forward TCP traffic from public internet to your localhost
- Access your local applications remotely via HTTPS
3.1 Service Limitations
- Session Duration: Free tier tunnels automatically expire after 3 hours
- No Authentication Required: Service is intentionally frictionless (no signup/login)
- No Guarantees: Service may be modified, suspended, or discontinued at any time without notice
- Best Effort: We strive for high uptime but do not guarantee 24/7 availability
4. Acceptable Use Policy
PROHIBITED USES: You may NOT use xpos.dev for any illegal, harmful, or abusive purposes.
4.1 Strictly Prohibited Activities
You agree NOT to use the Service to:
- Illegal Content: Host, transmit, or distribute illegal content including child exploitation material, pirated content, or stolen data
- Malware & Attacks: Distribute malware, viruses, ransomware, or conduct cyberattacks
- Phishing & Fraud: Create phishing sites, scams, or fraudulent schemes
- Spam: Send unsolicited commercial emails or messages
- DDoS & Abuse: Launch denial-of-service attacks or abuse the service infrastructure
- Harassment: Harass, threaten, or harm any person or entity
- Unauthorized Access: Attempt to hack, reverse-engineer, or bypass security measures
- Privacy Violations: Collect personal data without consent or violate privacy laws
- Cryptocurrency Mining: Use tunnels for unauthorized cryptocurrency mining
- Proxy/VPN Services: Operate public proxy services or VPN exit nodes
- Torrenting/P2P: Operate BitTorrent trackers or file-sharing services
- Adult Content: Host pornography or adult content services
- Gambling: Operate online gambling services without proper licensing
4.2 Acceptable Uses (Examples)
The Service is designed for legitimate development and testing purposes:
- Sharing local development servers with clients or team members
- Testing webhooks from third-party services (Stripe, GitHub, etc.)
- Demonstrating applications during meetings or presentations
- Testing mobile apps that need to communicate with local servers
- Temporary staging environments for debugging
- CI/CD integration testing
5. User Responsibilities
You are solely responsible for:
- Your Content: All data, files, and traffic tunneled through the Service
- Security: Securing your local development environment and SSH keys
- Compliance: Ensuring your use complies with all applicable laws
- Third-Party Consents: Obtaining necessary permissions for any data you collect or process
- Visitor Safety: Ensuring content shown to tunnel visitors is safe and legal
IMPORTANT: You are responsible for any activity conducted through your tunnels. We may log IP addresses and visitor data for security purposes.
6. Service Availability and Modifications
6.1 No Uptime Guarantee
We do not guarantee that the Service will be:
- Available at all times without interruption
- Free from errors, bugs, or security vulnerabilities
- Compatible with all systems or configurations
- Meeting your specific requirements
6.2 Service Modifications
We reserve the right to:
- Modify or discontinue the Service (or any part) at any time
- Change pricing, features, or limitations
- Impose usage limits or restrictions
- Remove or modify content that violates these Terms
7. Termination and Suspension
7.1 Immediate Termination
We may immediately terminate or suspend your access to the Service, without prior notice or liability, for any reason, including:
- Violation of these Terms or Acceptable Use Policy
- Suspected illegal activity or abuse
- Excessive resource consumption
- Legal or regulatory requirements
- Security threats or vulnerabilities
- Any other reason at our sole discretion
7.2 Effects of Termination
Upon termination:
- All active tunnels will be immediately closed
- Your access to the Service will cease
- We may delete associated data (subject to legal retention requirements)
- These Terms will remain in effect for provisions that survive termination
8. Intellectual Property
8.1 Our Property
The Service, including all software, code, design, trademarks, and content, is owned by xpos.dev and protected by copyright, trademark, and other intellectual property laws.
8.2 Your Content
You retain all rights to content you tunnel through the Service. By using the Service, you grant us a limited license to:
- Transmit and display your content as necessary to provide the Service
- Store metadata and logs as described in our Privacy Policy
We do NOT claim ownership of your tunneled content.
9. Disclaimers and Warranties
NO WARRANTIES: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
9.1 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties regarding accuracy, reliability, or availability
- Warranties that the Service will be uninterrupted, secure, or error-free
- Warranties that defects will be corrected

The Service does not constitute professional, legal, or technical advice. You should consult appropriate professionals for specific advice tailored to your situation.
10. Limitation of Liability
LIABILITY CAP: TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY IS LIMITED TO $100 USD.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
WE SHALL NOT BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions, errors, or security breaches
- Unauthorized access to or alteration of your transmissions or data
- Statements or conduct of any third party using the Service
- Damages resulting from your use or inability to use the Service
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF:
- $100 USD, OR
- Amounts you paid us in the 6 months preceding the claim (currently $0 for free tier)
10.2 Exceptions
Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless xpos.dev, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
- Content you tunnel through the Service
- Any illegal or harmful activity conducted through your tunnels
12. Privacy and Data Protection
Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key Privacy Points:
- We log IP addresses, user agents, and basic usage data
- Tunnel data is automatically deleted after 3 hours
- We do not inspect or store the contents of your tunneled traffic

13. DMCA and Copyright
We respect intellectual property rights. If you believe your copyright has been infringed through our Service:

- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing material (tunnel URL)
- Your contact information
- A statement of good faith belief that use is unauthorized
- A statement that the information is accurate and you are authorized to act

14. Export Controls
The Service may be subject to export control laws. You agree to comply with all applicable export and import control laws and regulations, including those of the United States and your country of residence.
15. Dispute Resolution and Governing Law

16.4 Assignment

16.5 No Agency
No agency, partnership, joint venture, or employment relationship is created between you and xpos.dev.
16.6 Force Majeure
We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, or government actions.
17. Changes to Terms
We may update these Terms at any time. Changes will be effective:
- Immediately upon posting for non-material changes
- 30 days after posting for material changes (with prominent notice)
Your continued use of the Service after changes constitutes acceptance of the updated Terms.
